Wilber F. Trout was indicted in the Circuit Court of Warren county for the first degree murder of Harvey Saffell. He was convicted by a jury of involuntary manslaughter, and his punishment fixed at four and one-half years in the State penitentiary. That verdict was approved by the trial judge, and is now before us on a writ of error.
